GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Provider Identification

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between:

Hereinafter referred to as "the Provider,"

 

and any individual or legal entity subscribing to the services offered by the Provider, hereinafter referred to as "the Client."

2. Purpose

The Provider offers a service connecting:

• students or their legal representatives;

• drivers and operators of school transport.

 

The service consists exclusively of organizing and facilitating the allocation of students to available transport providers based on the routes, schedules, and capacities declared.

 

The Provider acts as an intermediary and does not itself provide the transport services.

 

As the organizer, the Service Provider also ensures the professionalism of the drivers, the good condition of the vehicles, and the implementation by the carriers of essential safety measures, as detailed below.

3. Acceptance of the Terms and Conditions

Any order or subscription to a service implies full and complete acceptance of these Terms and Conditions.

The Client acknowledges having read the Terms and Conditions before using the service.

4. Description of Services

The Service Provider notably provides:

• student registration on the platform;

• registration of partner carriers;

• assignment of students to available transport routes;

• management of route change requests;

• administrative support related to the school transport service;

• route optimization for:

o the well-being of students:

* who will spend less time in transit,

* who will benefit from later departures from their homes;

 

• Reduced energy consumption for drivers,

• Reduced environmental impact;

• Rapid incident management;

• Communication with parents, particularly in the event of an accident;

• Rigorous monitoring of transported students, especially in the event of bus changes, to continuously monitor:

• Vehicle occupancy rates;

• Available seats in case of last-minute need to transport additional students or if a driver's authorization is revoked, to ensure the allocation of affected students and maintain continuity of transport services.

The Provider does not guarantee the continuous availability of a transport provider throughout the entire territory.

5. Role of the Provider

The Provider acts solely as a technical and commercial intermediary, with support available via WhatsApp or email.

 

The transport contract is concluded directly between:

• the student or their legal representative;

• the transport provider.

 

The Provider cannot be held liable for:

• transport delays;

• absences of the transport provider;

• Traffic accidents;

• Driver or student behavior;

• Any damage directly resulting from the provision of transportation.

 

Its role is to ensure that these situations are avoided through all available means.

6. Registration Conditions

The Client agrees to provide accurate and complete information, including:

• First and last name;

• WhatsApp contact information;

• Home address;

• School attended;

• Email address;

• Any information necessary for organizing transportation.

 

The Client remains responsible for the accuracy of the information provided.

7. Pricing

The prices listed below apply to our services as described on the main page.

These are not the fares, which are set independently by the driver.

The applicable prices are those in effect at the time of booking.

Prices are provided before any subscription. You will then be able to use our services at the price shown below, and we will inform you of the price set by the carrier before you commit to our service.

Our service prices are fixed and correspond to one month of bus travel, with a minimum of 2,500 Rs per child.

A 50% discount applies for the second child and subsequent children if all children from the same family depart and return at the same time and address.

For example, for a family with three children departing and returning at the same time to a shared address: 2500 + 1250 + 1250 = 5,000 Rs.

The optional real-time bus tracking service is available for 500 Rs per month, payable at the beginning of each month upon receipt of the invoice.


8. Payment Terms

The amount is payable in full via Juice or bank transfer to the company account.

Unless otherwise specified, invoices are payable upon receipt.

The transportation itself is paid directly by the family to the driver, without any intervention on the price.

However, we will inform you of the transportation price before you register for our services.

9. Late Payment

Any late payment may result in the immediate suspension of service.

10. Modification or Cancellation

All requests for modification or cancellation must be submitted in writing.

The Service Provider reserves the right:

• to accept or refuse the requested modification;

• to invoice any administrative fees incurred.

 

No pro-rata discount is offered for registrations made during the academic year.

 

Similarly, no refund is provided if a student ceases to use the dispatch or bus service, or if the bus service is interrupted due to inclement weather or any other reason, regardless of the duration of the service interruption.

11. Carrier Obligations

Partner carriers agree to:

• hold the required licenses and authorizations;

• maintain their insurance coverage;

• comply with the highway code;

• ensure the safety of transported passengers;

• guarantee one seat with a seatbelt per student, regardless of the student's age; A bus may not transport more children than it has seats, even if the law permits it, in order to meet the Client's expectations.

Each carrier remains solely responsible for its activity but may be subject to inspection without prior notice by the Service Provider.

In the event of refusal to submit to inspection or failure to comply with the charter, which includes the essential safety elements mentioned above, the carrier may be excluded from the drivers transporting children whose parents use the Service Provider's services. The Service Provider will then assign the students concerned to another available bus so that they can continue to benefit from transportation to and from school.

12. Parental Obligations

In accordance with the law, the parents/legal guardians of minor children are responsible for their safety. Dispatch assigns the designated driver to their geographic area, who is responsible for the contractual obligations defined above. Parents/legal guardians are responsible for:

• respecting the pick-up/drop-off times and reminding their child(ren) of the rules of courtesy and respectful behavior;

• in case of delay, notifying the transport provider as soon as possible and providing them with the necessary instructions or information for picking up or dropping off their child(ren).

To allow the transport provider to meet its commitments, particularly regarding schedules, to other users, any repeated delays by parents/legal guardians exceeding a reasonable timeframe may result in a progressive penalty, up to and including exclusion from the bus service, so as not to penalize other students using the bus, without compensation or reimbursement for the current month already paid. The same applies in the event of behavior that disrupts the smooth running of the journeys and/or compromises the safety of the journeys.

13. Provider's Liability

The Provider is bound by an obligation of means.

 

Its liability is strictly limited to providing the matching service.

 

The Provider shall not be held liable for:

• indirect damages;

• financial losses;

• operating losses;

• incidents occurring during transport.

The Provider's total liability, regardless of the cause, shall not exceed the amount of service fees actually collected during the last twelve months.

14. Force Majeure

The Provider shall not be held liable for the non-performance of its obligations in the event of force majeure, including but not limited to:

• natural disasters;

• strikes;

• epidemics;

• interruptions of communication networks;

• government decisions.

15. Protection of Personal Data

The data collected is used solely for:

• the organization of school transport;

• the management of registrations;

• Communication with users;

• Service improvement.

Data is not sold or transferred to unauthorized third parties.

The Client has the right to access, rectify, and delete their data by contacting:

16. Intellectual Property

All elements of the platform, including:

• software;

• databases;

• texts;

• logos;

• trademarks;

remain the exclusive property of the Provider.

Any unauthorized reproduction is prohibited.

17. Termination

The Provider may suspend or terminate access to the service in the event of:

• non-payment;

• fraud;

• provision of inaccurate information;

• violation of these Terms and Conditions.

18. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Mauritius.
